AI and Biometric Notice and Consent

InstaMall’s Virtual Try-On tool is an automated AI-enabled feature, not a human stylist, retailer representative, or live chat service. The images and fit visualizations generated by the tool are simulations provided for convenience only and may not accurately reflect actual fit, sizing, color, texture, drape, proportions, product availability, or how an item will appear in person. Virtual Try-On is available only for eligible products. Certain products, including some underwear, intimate apparel, lingerie, swimwear, highly customized items, and other products identified in the Services are not eligible for this feature.

InstaMall offers this tool to help you visualize how the offered apparel and accessories look on you. This technology detects and analyzes anatomical landmarks and proportions, which may generate measurements or data that constitute a scan of face or body geometry, or other biometric identifiers and biometric information under applicable law (“Biometric Data”). Your photo and any associated Biometric Data are collected, used, and processed solely to align and render selected clothing items onto your image and display the resulting simulated images to you.

Photos, generated try-on imagery, and any derived Biometric Data are subject to the Privacy Policy, and the Biometric Data Retention Policy.

When you tap “Agree & Continue” in the InstaMall app, you:

• Acknowledge that you have read and understood this Biometric Notice;
• Provide your informed, written consent for InstaMall and its authorized service providers to collect and use your image, photos, and any Biometric Data derived therefrom for the specific purposes described above; and
• Certify that you are 18 years of age or older and that any uploaded photo is of yourself or an individual for whom you are legally authorized to provide consent.
