Biometric Data Retention and Destruction Policy

This Biometric Data Retention and Destruction Policy (this “Policy”) describes how InstaMall, LLC (“InstaMall,” “we,” “us,” or “our”) collects, uses, retains and deletes biometric identifiers, biometric information, and related photos or images that may be collected, created, or processed when you use InstaMall’s AI Try-On, AI Stylist or other image based services (collectively, “AI Features”). This Policy supplements InstaMall’s Privacy Policy, Terms of Use, and any point-of-collection notice and consent presented before you upload a photo or access your camera for the AI Features.

Data Covered by this Policy

When you upload a photo or use your camera for the AI Features, InstaMall and its authorized partners may process your photo, image, or video, including visible physical characteristics, using artificial intelligence, computer vision, and related technologies. The AI tools may detect or analyze anatomical landmarks and proportions, such as posture, limbs, body contours, and/or facial features, and may generate measurements that constitute a scan of face or body geometry, or other biometric identifiers or biometric information under applicable law (collectively, “Biometric Data”).

Notice and Consent

InstaMall will provide a point-of-collection notice and obtain your written electronic consent before collecting, capturing, receiving, storing, disclosing, or otherwise processing Biometric Data through the AI Features where required by law. InstaMall will not use Biometric Data to identify you in the real world, authenticate your identity, train general-purpose AI models, or make eligibility decisions unrelated to the AI Features unless we provide additional notice and obtain any consent required by law.

Retention Schedule

InstaMall retains photos, generated imagery, and Biometric Data only for as long as necessary to provide the AI Features and satisfy the specific purposes disclosed to you at the time of collection. By default, photos, generated imagery, and Biometric Data are retained only for the duration of your active session. If InstaMall offers, and you choose to use, a feature that lets you save try-on looks in your account or return to them later, InstaMall and its authorized technology service providers may retain the related photos, generated imagery, and Biometric Data for up to thirty (30) days unless a shorter period is presented to you at the time of collection.

In all cases, InstaMall will permanently destroy Biometric Data when the initial purpose for collecting or obtaining the Biometric Data has been satisfied or within three (3) years of your last interaction with the AI Features, whichever occurs first, unless a valid warrant, subpoena, court order, or other applicable law requires retention for a longer period.

Changes to this Policy

InstaMall may update this Policy from time to time. If we make material changes to this Policy or to the way we collect, use, retain, disclose, or destroy Biometric Data through the AI Features, we will provide notice as required by law and obtain any consent required before applying the changes to Biometric Data collected after the change.
