DMCA & Copyright Policy

Overview
Instamall, LLC (“Instamall”) respects the intellectual property rights of others and expects all users of our Services — including Retailers, consumers, and other third parties — to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), 17 U.S.C. § 512, Instamall will respond promptly to claims of copyright infringement committed using the Instamall platform.
This policy applies to all content on the Instamall platform, including but not limited to product listings, product images, product descriptions, reviews, ratings, photos, videos, and other user-generated or Retailer-generated content.

Filing a DMCA Takedown Notice
If you are a copyright owner (or authorized to act on behalf of one) and believe that content on Instamall infringes your copyright, you may submit a DMCA takedown notice to our designated agent. Your notice must include the following:
1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
2. Identification of the copyrighted work claimed to have been infringed. If multiple works are covered by a single notification, a representative list of such works.
3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Instamall to locate the material (e.g., direct URL links to the content on our platform).
4. Information reasonably sufficient to permit Instamall to contact you, including your name, address, telephone number, and email address.
5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

How Instamall Responds to Takedown Notices
Upon receipt of a valid DMCA takedown notice, Instamall will:
1. Promptly remove or disable access to the allegedly infringing content.
2. Notify the user or Retailer who posted the content that it has been removed or disabled, and provide a copy of the takedown notice.
3. Inform the user or Retailer of their right to file a counter-notification (see below).
Filing a Counter-Notification
If you believe that content you posted was removed or disabled by mistake or misidentification, you may submit a counter-notification to our designated agent. Your counter-notification must include:
1. Your physical or electronic signature.
2. Identification of the material that was removed or disabled and the location at which it appeared before it was removed or disabled.
3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located (or if you are outside the United States, the Southern District of Florida), and that you will accept service of process from the person who provided the original takedown notice or an agent of such person.

Upon receipt of a valid counter-notification, Instamall will forward the counter-notification to the original complainant. If the original complainant does not file a court action seeking to restrain the user from engaging in the allegedly infringing activity within 10–14 business days, Instamall will restore the removed content.
Repeat Infringer Policy
Instamall maintains a policy of terminating the accounts of users and Retailers who are repeat copyright infringers, in appropriate circumstances. If a user or Retailer receives multiple valid DMCA takedown notices, their account may be suspended or permanently terminated at Instamall’s sole discretion.
Misrepresentation Warning
Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material was removed or disabled by mistake, may be subject to liability for damages, including costs and attorneys’ fees. Please do not make false claims.
Trademark Concerns
This policy addresses copyright infringement under the DMCA. If you have a trademark concern (e.g., counterfeit products or unauthorized use of your brand on our platform), please contact us at legal@instamall.co with details of the concern, and we will investigate.
