Law Enforcement Guidelines

Overview
Instamall, LLC (“Instamall”) is committed to protecting the privacy of our users while cooperating with law enforcement in accordance with applicable law. These guidelines describe the types of data Instamall may maintain, the legal process required to obtain that data, and how to submit requests.
These guidelines do not constitute legal advice and do not create any enforceable rights. Instamall reserves the right to update these guidelines at any time without notice.
Legal Framework
Instamall discloses user information to law enforcement and other governmental entities in the United States where required by valid legal process issued pursuant to the Electronic Communications Privacy Act (“ECPA”), 18 U.S.C. §§ 2701–2712, and other applicable legal authorities. The type of legal process required depends on the category of information requested.
Types of Data Available
The data Instamall collects and maintains varies from account to account. The following are general categories of data that may be available:
Basic Subscriber Information
Name, email address, phone number, billing address, delivery addresses, account creation date, and account status.
Required legal process: Valid subpoena or equivalent legal process.
Transaction and Order Records
Order history, order details (items, Retailers, amounts), payment transaction records (limited — full payment card data is held by Stripe, not Instamall), delivery addresses, and timestamps.
Required legal process: Valid subpoena or court order issued under 18 U.S.C. § 2703(d).
Communications Content
In-app messages between users and Instamall support, and communications routed through our platform (e.g., customer-Retailer messages).
Required legal process: Search warrant issued upon a showing of probable cause, pursuant to applicable federal or state law.
Location Data
Delivery addresses associated with orders. Precise geolocation data, if collected, is available only to the extent the user enabled location services.
Required legal process: Search warrant.
Device and Technical Information
IP addresses, device identifiers, browser/app information, and access logs.
Required legal process: Valid subpoena or court order.
Submitting a Request

Please include the following with your request: the requesting agency and officer name, badge number or official identification, a valid email address from an official government domain, the specific Instamall account(s) or data being requested (with as much identifying information as possible, such as email address, phone number, or order number), the legal process (subpoena, court order, or warrant) attached as a PDF, and any applicable non-disclosure or sealing orders.
Emergency Requests
If there is an emergency involving danger of death or serious physical injury to any person, law enforcement may submit an emergency disclosure request to legal@instamall.co with the subject line “EMERGENCY LAW ENFORCEMENT REQUEST.”
The emergency request must describe in detail the nature of the emergency, including the specific threat of death or serious physical injury, and explain why the information is needed immediately. Instamall will evaluate emergency requests on a case-by-case basis and may disclose information when we have a good-faith belief that an emergency exists. Emergency requests do not replace the requirement for valid legal process; we may require follow-up legal process for any initial or additional disclosure.
Preservation Requests
Law enforcement may request that Instamall preserve records in connection with an official investigation. Preservation requests should reference specific account(s) and be sent to legal@instamall.co. In accordance with 18 U.S.C. § 2703(f), Instamall will preserve the specified records for 90 days, renewable upon request. Preservation requests do not compel disclosure; separate legal process is required to obtain the preserved records.
User Notice Policy
It is Instamall’s policy to notify users about law enforcement requests for their data before disclosure, unless notification is prohibited by law (e.g., by a court order or statutory non-disclosure requirement). If a non-disclosure order expires, Instamall may then notify the affected user.
Payment Data
Instamall does not store full payment card numbers. All payment card data is processed and stored by Stripe, Inc. For requests related to payment card information, law enforcement should contact Stripe directly in accordance with Stripe’s own law enforcement guidelines.
Delivery Data
Delivery is facilitated by a third-party delivery service provider. Detailed delivery data (such as courier identity, real-time GPS tracking during delivery, and courier-specific information) may be maintained by our delivery partner rather than by Instamall. For delivery-specific data beyond what Instamall maintains (delivery addresses and status), law enforcement may need to serve separate legal process on the delivery partner.
Cost Reimbursement
Instamall may seek reimbursement for costs incurred in responding to law enforcement requests, as permitted by law (see 18 U.S.C. § 2706).
International Requests
Instamall currently operates in the United States. Law enforcement authorities outside the United States seeking data from Instamall should follow the relevant mutual legal assistance treaty (MLAT), letter rogatory, or similar process for obtaining data from a U.S. company.

Q: How long does it take Instamall to respond to a request?
A: Instamall aims to respond to valid legal process as quickly as reasonably possible. Response times depend on the nature and scope of the request. Emergency requests are prioritized.
Q: Can I submit a request by phone?
A: No. All requests must be submitted in writing via email or mail to the addresses above.
Q: What should law enforcement do with records obtained from Instamall once an investigation is complete?
A: Information obtained from Instamall should be handled and disposed of in accordance with applicable law and the requesting agency’s data retention policies.
